THE RETURN OF THE MAC (HELL, NO! THE BOOK!!)

Hi, I don't know if this has been reported this time, as wide and high as the "Mccannorama" ;) from the BBC, anyway if it hasn't, here's the shout:

G. AMARAL's BOOKS were to be returned yesterday 26th April 2012 to his publishers. Were they? A few people have exclaimed - and rightly- that the BBC "Panorama" was a strategy (of PROPAGANDA, as I've already qualified it) to DIVERT from this presumably known in advance FACT.

By the way the BBC has never mentioned (or correct me if I'm wrong) that Mr G. AMARAL has WON this trial against the McCanns and that the 7 500 copies of his CONFISCATED BOOKS were DUE BACK TO HIM, and subsequently FREE to be sold again. Consequently they are also FREE to be translated into ENGLISH and PUBLISHED IN GREAT BRITAIN.

(Curiously from what I understand they were never banned anywhere else but in Portugal or other Portuguese speaking countries, but no publisher in GB had ever had the "gutts" to put it on the Market! W@nkers, LOL)

McCann Case: Judge orders the immediate return of Gonçalo Amaral's Book

Following the ruling of the Court of Appeals of Lisbon on October 14, 2010 in which the judges decreed that Gonçalo Amaral's books could be sold, revoking the first judgement of the Court a quo [lower court/court decision's that was appealed] that had granted a banning injunction, and in a new legal setback for the McCanns, we can now confirm that the judge has ordered the immediate return of the 7.500 copies of the book "Maddie, the Truth of the Lie" that were entrusted to Isabel Duarte, lawyer of the McCann couple. The lawyer has, of today, 10 working days to fulfil that order.

On the other hand, we are also able to confirm that one of the several claims for defamation made by the McCann couple against several Portuguese persons, specifically one targeting criminal psychologist and university professor Dr. Paulo Sargento as been archived by the Public Ministry. Nevertheless, and according to information that was provided to us, the McCanns' lawyer, Isabel Duarte, intends to proceed with the claim despite not having the backing of the Public Ministry.

The Civil Court of Lisbon notified the McCanns' lawyer on Tuesday

Early on this week, the lawyer for Guerra & Paz book publishers said that the book copies were stored at a warehouse in the area of Matinha in Lisbon, and that, they should be returned as soon as there was a court order. The 1st Circuit of the Civil Court of Lisbon [the same court that had granted the initial injunction on September 9, 2009] has now notified, Isabel Duarte, the books' trustee, ordering her to return the books to Guerra & Paz, within 10 days.

Update on March 23, 2012
The mandatary and lawyer of the McCann couple, Isabel Duarte, has until the 29th of this month to return the books; the 10 days deadline are not consecutive and are measured as working days. Meanwhile, the lawyer to whom the books were entrusted by the First Instance Civil Court of Lisbon, has been trying to delay the restitution of the books to its rightful owners as ordered by the Supreme Court of Justice alleging that the Court of Appeals judgement did not transit in rem judicatam [unappealable decision/final ruling].

The child’s parents immediately attributed the fact (disappearance) to the action of a third party, defending the ABDUCTION.

The group’s members held a meeting during which they agreed on certain rules that sustained a version of continuous checking of the children, while they dined


By reasons, they said, of counselling and support, the parents asked for the presence of a priest, at around 02:00h/03:00h on the 04th of May.


There is a coincidence between the marking of cadaver odour and blood, according to the (partial) Laboratory Report that has been annexed to the process files.


Said marking occurred behind the living room sofa (cadaver odour / blood / DNA), which indubitably proves that said piece of furniture was pushed back by someone, after the death of Madeleine McCann was verified. Because of the few traces that were recovered on location and subject to examination, it has to be admitted as a strong hypothesis that it was subject to a “washing”, at a moment following the occurrence of death.


In the same manner, the soft toy that was used by the dead child, which was found at the top of the bed where she usually slept (cf. photos from the initial inspection) reveals that someone put it there at a moment posterior to death, given the fact that the bed doesn’t have any cadaver odour


This is to say, an intentional modification took place, in order to simulate a “picture” that doesn’t match reality, in an attempt to take advantage for the simulation of an abduction scenario;


It must be added that the cadaver odour detection dog strongly signalled the bedroom where the McCann couple slept, which may indicate the moving of the corpse from the actual death spot (living room) into a non visible part of said bedroom;


Furthermore a strong marking of cadaver odour was made on Kate McCann’s clothes, which may indicate that she was in touch with the cadaver;

There was also a strong marking of cadaver odour in the car that was used by the McCann couple (since the 27th of May 2007), which in conjugation with the blood dog’s marking and based on the forensics that are included in the process files, which indicate the presence of Madeleine McCann’s DNA in the car boot, lead towards not excluding a strong hypothesis that this vehicle may have possibly been used move the cadaver, 24 days after the death;

The indication from the cadaver odour detection dog, as well as from the blood detection dog, on the key of the aforementioned vehicle, where the laboratory would confirm the existence of Gerald McCann’s DNA, cannot be dismissed. This last signalling was obtained by the dogs after the key was put far away from the vehicle, in a non visible location.

From everything that is exposed, the process files result in the following:



A) the minor Madeleine McCann died in apartment 5A at the Ocean Club resort in Praia da Luz, on the night of the 3rd of May 2007;



B) a simulation of an abduction took place;



C) in order to render the child’s death impossible before 22H00, a situation of checking of the McCann couple’s children while they slept was made up;



D) Kate McCann and Gerald McCann are involved in the concealment of the cadaver of their daughter, Madeleine McCann;



E) at this moment, there seem to be no strong indications that the child’s death was not the result of a tragic accident, yet;



F) from what has been established up to now, everything indicates that the McCann couple, in self-defence, doesn’t want to deliver the cadaver immediately and voluntarily, and there is a strong possibility that it was moved from the initial place of deposition.



This situation may raise questions concerning the circumstances in which the death of the child took place.

Conclusions:


From everything that we have discovered, our files result in the following conclusions:


A. the minor Madeleine McCann died in Apartment 5A at the Ocean Club resort in Praia da Luz, on the night of 3 May 2007



B. a simulation - a staged hoax - of an abduction took place



C. in order to render the child’s death impossible before 10.00pm, a situation of checking of the McCann couple’s children while they slept was concocted



D. Dr Gerald McCann and Dr Kate McCann are involved in the concealment of the corpse of their daughter, Madeleine McCann



E. at this moment, there seems to be no strong indications that the child’s death was other than the result of a tragic accident, yet;



F. from what has been established up to now, everything indicates that the McCann couple, in self-defence, did not want to deliver up Madeleine’s corpse immediately and voluntarily, and there is a strong possibility therefore that it was moved from the initial place where she died. This situation may raise questions concerning the circumstances in which the death of the child took place.



G. Therefore, we suggest that the case files are sent to the Republic’s Prosecutor, in the Lagos legal district, for:



1) possible new questioning of the arguidos Dr Gerald and Dr Kate McCann, and



2) an evaluation of the measure of restraint to be applied in this case.



During the house search at the McCann couple’s residence, a diary style manuscript was found, already photocopied, possibly authored by Dr Kate McCann; admitting that it may contain information that may help to reach the material truth of facts.



We therefore propose that the photocopies of the said document are presented to the illustrious judge for the purpose of its apprehension (if legal), its translation and eventual collection of information to be included in the files, as necessary for the investigation.



At this date, I submit the case files for your appreciation, for you to determine whatever you may see as convenient.
